Pursuant to ARS Section 10-3708, a written ballot may be delivered via an online voting system so long as the online voting system: (1) Authenticates the member’s identity; (2) Authenticates the validity of each electronic vote to ensure that the vote is not altered in transit; (3) Transmits a receipt to each member who casts an electronic vote; and (4) Stores electronic votes for recount, inspection and review purposes.
Several companies now provide safe, secure and accurate online voting services designed specifically for community associations, which comply with the requirements set forth above. Please contact our office for a list of these service providers.
Online voting can reduce the costs associated with the voting process and increase voter participation due to ease of use. However, please note that even if the Association utilizes online voting, it still must provide an in-person voting option
